The Commission shall take into account specific criteria, including intended purpose, extent of use, data nature, autonomy, past harm, potential harm, dependency, power imbalance, corrigibility, benefits, and existing Union law measures, when assessing whether AI systems pose risks equivalent to or greater than existing high-risk systems.
